as the Manager of the Walbrzych Special Economic Zone \u201cINVEST \u2013 PARK\u201d, according to the ordinance of the Minister for Economy and Labour dated November 15th , 2004 on tenders and negotiations, as well as on criteria for evaluating the intended business undertakings which are to be commenced by business entities within the area of the Walbrzych Special Economic Zone INVEST \u2013 PARK (Journal of Laws No. 254, item. 2550, as amended) announces an invitation to the negotiations aimed at selecting an entrepreneur who will obtain a permit for carrying out a business activity within the area of the WSEZ \u201cINVEST \u2013 PARK\u201d which gives a right to benefit from public aid (called hereafter \u201cPermit\u201d).
\n1) The invitation is aimed at entrepreneurs who possess the legal title for the real estate (in particular ownership or perpetual usufruct or lease or rental or leasing) located within the area of the WSEZ \u201cINVEST \u2013 PARK\u201d in the Wrze\u015bnia Subzone or at these who will prove believably the possibility of obtaining of such legal title.
\n2) The negotiations may be participated only by the entrepreneurs mentioned in point 1 above and who intend to conduct a business activity within the area of the WSEZ \u201cINVEST \u2013 PARK\u201d, based on the Permit, satisfying the terms and conditions set down in the Special Economic Zones Act dated October 20th ,1994 (consolidated text Journal of Laws of 2015 Item 282) and in the Ordinance of the Council of Ministers dated December 10th, 2008 on public aid which is granted to the entrepreneurs operating based on the permit for conducting the business activity within the area of special economic zones (consolidated text Journal of Laws of 2015 Item 465) and in accordance with the Ordinance of the Minister of Economy dated August 31st, 2009 concerning settlement of the development plan of the Wa\u0142brzyska Specjalna Strefa Ekonomiczna INVEST-PARK (Journal of Laws No. 158, item 1253).
\n3) Detailed information on the terms and conditions of the negotiations, including the condition of issuing the Permit, is set down in the \u201cSpecification of Material Terms and Conditions of the Negotiations No. 395\u201d (called hereafter \u201cSpecification\u201d).
\n4) The condition to participate in the negotiations is purchasing from the WSEZ \u201cINVEST \u2013 PARK\u201d sp. z o.o. the Specification.
\n5) Specification is available every day, except for Saturdays, Sundays and holidays from 745 a.m. to 300 p.m. at the seat of the WSEZ \u201cINVEST \u2013 PARK\u201d sp. z o.o., upon payment of PLN 12,300.00 gross (say: twelve thousand and three hundred zlotys gross) including VAT to the following bank account of the WSEZ \u201cINVEST \u2013 PARK\u201d sp. z o.o.: No. 23 1020 5095 0000 5202 0007 4138 in PKO BP S.A. O\/Wa\u0142brzych; no additional terms and conditions of the negotiations are anticipated, except for those defined in the present invitation and in the Specification.
\n6) The business undertakings, which are to be commenced within the area of the Walbrzych Special Economic Zone \u201dINVEST \u2013 PARK\u201d and which will be defined in offers, are subject to assessment based on the criteria defined in \u00a7 11 of the Ordinance of the Minister for the Economy and Labour dated November 15th, 2004 on tenders and negotiations, as well as on criteria for evaluating the intended business undertakings which are to be commenced by business entities within the area of the Walbrzych Special Economic Zone INVEST \u2013 PARK (Journal of Laws No. 254, item 2550, as amended).
\n7) Written offers should be submitted in closed envelopes at the seat of the WSEZ \u201cINVEST \u2013 PARK\u201d sp. z o.o. (58-306 Walbrzych, Uczniowska 16 street) by October 15th, 2015, 3 p.m.; the manner of preparing the offer is defined in the Specification.
\n8) The opening of the envelopes as well as the negotiations will take place at the seat of the WSEZ \u201cINVEST \u2013 PARK\u201d sp. z o.o. on September 16th, 2015 at 9 a.m.
\n9) The WSEZ \u201cINVEST \u2013 PARK\u201d sp. z o.o. may invalidate the negotiations in the event of a material change of circumstances resulting in that the continuation of the negotiation procedure is not in the public interest, which could not have been predicted earlier or\/and when the negotiation procedure has a defect which makes it impossible to issue the Permit. The WSEZ \u201cINVEST \u2013 PARK\u201d sp. z o.o. will inform all offerors at the same time, in writing, about invalidation of the procedure, giving the factual and legal reasons therefore.
